This Privacy Policy explains how Exodus Finance Pty Ltd collects, holds, uses and discloses your personal and credit information, and how you can access, correct or query that information.

01 Privacy Consent

Exodus Finance Pty Ltd (ABN 99 681 802 326), an Authorised Credit Representative (ACR #565041) of Fintelligence Pty Ltd, Australian Credit Licence #511803 — referred to below as "Exodus Finance", "we", "us" or "our" — collects, holds, uses and discloses personal information and credit information in accordance with this Privacy Policy. A copy of this policy is available at any time by contacting us on 1300 278 929 or via approvals@exodusfinance.com.au.

By engaging with us or providing your information, you agree that we may collect, hold, use and exchange your personal and credit information for the purposes described in this document. This policy also explains how you can raise a concern about a privacy breach, and how to access or correct the information we hold about you.

02 What Is Personal Information

Personal information is any information or opinion about an identifiable individual. The personal information we typically collect includes your name, date of birth, gender, contact details, address, employment details, and any other information reasonably required to identify you and assess your needs.

03 What Is Credit Information

Credit information is personal information relating to credit you have applied for or been provided. This can include details of credit you've applied for, default information, and other information relevant to assessing your creditworthiness. It also includes information supplied to us by a credit reporting body, and anything we derive from it.

We collect, hold, use and disclose your personal and credit information to:

  • assess and verify your identity and financial situation;
  • assess your credit application, or your suitability as a guarantor;
  • provide relevant information to a guarantor or related applicant;
  • exchange information with a credit reporting body;
  • disclose information to credit providers in order to arrange finance;
  • disclose information to our aggregation partner where relevant;
  • disclose information to an insurer where you wish to arrange insurance;
  • obtain from, and disclose to, third parties such as your employer, landlord, real estate agent, lending institution or guarantor, where reasonably necessary to arrange finance or insurance; and
  • refer you to other organisations, service providers or business partners, or accept referrals from them.

Without the ability to collect, hold, use and disclose this information, we may not be able to provide credit assistance.

04 Verifying Your Identity

We are required under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) to collect and use personal and credit information to verify your identity. We are also required under the National Consumer Credit Protection Act 2009 (Cth) to collect and take reasonable steps to verify your financial situation, which may include enquiries through a credit reporting body.

05 Authority To Make Enquiries

You authorise us to request personal and credit information from credit providers and credit reporting bodies on your behalf. This includes authorising relevant credit providers to:

  • obtain a report about your commercial credit worthiness for the purpose of assessing your application, where you are the borrower;
  • exchange information about your credit arrangements with other credit providers for the purposes of assessing your application, notifying a default, or assessing your general creditworthiness;
  • disclose your information to a nominated guarantor so they can consider whether to act as guarantor; and
  • obtain a credit worthiness report where you are being considered as a guarantor.

You acknowledge this may include any information about your personal or commercial credit worthiness, standing, history or capacity that the Privacy Act 1988 (Cth) permits credit providers to exchange.

06 Who We Share Information With

We may disclose or exchange your personal and credit information with:

  • potential credit providers and insurers as part of our credit assistance process;
  • third parties to verify details provided, including agents, guardians, attorneys and employers;
  • our related entities, assignees, agents, contractors and advisers;
  • law enforcement, government and regulatory bodies;
  • any person who refers you to us;
  • joint applicants and guarantors;
  • financial institutions involved in a payment; and
  • debt collection agencies, where relevant.

We do not disclose your personal or credit information to any overseas recipient.

07 Credit Reporting Bodies

We may exchange personal and credit information with a credit reporting body in order to:

  • obtain a credit report on an applicant or guarantor as part of the credit assistance process;
  • use information supplied by a credit reporting body to conduct a preliminary assessment of a proposed application; and
  • verify the identity of an applicant or guarantor against information held by a credit reporting body.

Our current credit reporting body is Equifax. They can be contacted on 13 8332 (Mon–Fri, 8:30am–6:00pm AEST) or via equifax.com.au, where their own Privacy Policy is also available.

08 Credit Providers

We may submit your application to one or more credit providers from our lender panel. Where a credit provider holds information relevant to your eligibility, they are required to share this with us, you, or someone you've authorised to act on your behalf. If your application proceeds, the credit provider may separately request your consent to collect and use your information. A copy of our current lender panel is available on request via approvals@exodusfinance.com.au.

09 Our Aggregation Partner

We hold a finance aggregation arrangement with Fintelligence Pty Ltd (ABN 80 625 017 174), Australian Credit Licence #511803, which gives us access to a broad panel of lenders. We may use their systems as part of our credit assistance process, and may share relevant details as part of standard compliance audits.

10 Your Rights

You have the right to:

  • request the personal and credit information we hold about you;
  • request correction of any information that is inaccurate;
  • request a copy of this Privacy Policy;
  • ask that a credit reporting body not use your information for pre-screening or direct marketing; and
  • request a copy of the information a credit reporting body holds about you.

11 Marketing Communications

From time to time we may contact you with information about products and services we offer. You can opt out of marketing communications at any time by contacting us on 1300 278 929 or via approvals@exodusfinance.com.au.

12 Electronic Communications

If you provide us with an email address or mobile number, you consent to us using these to send notices and relevant documents, including those from a credit provider or insurer. You're responsible for maintaining the hardware and software needed to access these communications, and should check your nominated channels regularly. Paper copies may not be provided unless legally required. You can withdraw your consent to electronic communication at any time by contacting us.
